Rafael Contreras Ochoa Gets 15 Years in Prison for Battery on Ex-Girlfriend and an Elderly Disabled Man

A Santa Rosa man was sentenced to 15 years in prison in Sonoma County Superior Court this morning for battery of his pregnant ex-girlfriend and assault of a man who came to her aid. Rafael Contreras Ochoa, 39, pleaded guilty to the charges and admitted causing great bodily injury on the two victims in return for a stipulated 15-year prison term.

The assault and battery happened during an argument on Aug. 25 in front of a 60-year-old man’s home on Russell Avenue in Santa Rosa who was being cared for by Ochoa’s ex-girlfriend. The Sonoma County District Attorney’s Office said Ochoa knocked out both victims during the altercation which occurred after Ochoa and his girlfriend broke up.

The 60-year-old disabled man suffered a broken nose and fractured leg, Ochoa’s attorney Barry McBride said. Both victims were taken to the hospital. Ochoa’s ex-girlfriend was eight months pregnant and briefly went into labor after the assault, but hospital staff were able to forestall delivery of the baby girl who was born three weeks later. McBride said it’s uncertain if Ochoa is the baby’s father. “I want him to know no matter what he did to me I forgive him but not for what he did to my child while she was inside me.

Something is wrong with her head,” the woman told Judge Shelly Averill. “He can’t continue doing this to other women and get away with it, especially when they are pregnant,” she said. Ochoa apologized to his ex-girlfriend and said he prays for her and the baby. “I hope she gets better as she gets older,” Ochoa said.

The judge called the incident “a devastating situation” that apologies could not remedy. Deputy District Attorney Chris Honigsberg said Ochoa has two prior prison terms for theft related charges and will serve 85 percent of his sentence.
