A couple and their 12 year old son were woke up early this morning when an intruder entered their home in the 5200 block of Oakdale Waterford Hwy near Oakdale. The couple was forced to protect themselves and shot the suspect while he was inside their residence. More details below video.

The incident began at approximately 3:30 AM this morning when Modesto Police Department located a reported stolen vehicle. The vehicle, a 2001 Hyundai, began evading police when they attempted to stop it. The pursuit led them out of Modesto and into the city of Riverbank. For public safety, Modesto Police Department canceled their pursuit. The vehicle was last seen heading east out of Riverbank.
The vehicle was later found off Oakdale Waterford Hwy just north of the victims home. It appeared the suspect had lost control and high centered the vehicle.
At approximately 4:00 AM this morning the victims were sleeping at their residence in the 5200 block of Oakdale Waterford Hwy. The husband was awoke by a noise and found the suspect standing inside his residence. The wife and husband armed themselves with handguns, called 911 and confronted the suspect. The suspect was later identified as Albert Anthony Liberini, 27 years old out of Modesto. It appears Liberini may have entered the residence in an attempt to flee police.
The husband told Liberini to get out of his house. Liberini went out through their back door. A short time later Liberini tried to break into the house again by breaking out the glass in the back door. In fear, the wife fired two shots at Liberini, stopping him from entering the residence.
Liberini then went to a bedroom window of the residence and broke into the residence a second time. The husband confronted Liberini telling him to leave. Liberini continued to come at the husband inside the home. After several commands to stop, the husband fired one shot, striking Liberini in the torso.
Liberini was held at gun point until Deputies could arrive and take him into custody. He was transported to the hospital by ambulance and is currently in surgery with no life threating injuries.
None of the victims were physically injured during the incident.
Liberini is currently on probation for possession of control substance and out on bail on a separate possession of controlled substance case.
Once he is released from the hospital, Liberini will be booked for Burglary, Robbery, and Violation of Probation. He will also be charged with a bail enhancement for committing a crime while out on bail.
