* Gabriel Franco, Hugo Chavez and Eddie Sandoval Indicted by Grand Jury in Connection with 2008 Murder of Raul Lopez in San Jose

San Jose Police Department Press Release 11/14/12

The Santa Clara County Grand Jury has indicted three suspects believed to be responsible for the March 2008 homicide of 18 year old San Jose Resident Raul Lopez as well as a second shooting incident that occurred in April of 2008. On March 28th, 2008, officers responded to the area of Dobern Avenue and Summer Street in East San Jose and located two shooting victims. One of the victims, Raul Lopez, died shortly after the shooting. The other victim survived.

In April 2008 incident, which occurred in the 0-100 block of McCreery Avenue, two victims were shot and received life-threatening wounds. Both victims ended up surviving their injuries.

Both the Dobern Avenue and McCreery Avenue incidents were gang-motivated. Suspects Gabriel Franco and Eddie Sandoval were already in custody on unrelated charges at the time of the indictments. The San Jose Police Department’s Covert Response Unit located and arrested Suspect Hugo Chavez on 11/07/2012 in Hayward, California. All three suspects remain in custody.

Suspect Gabriel Franco was indicted on both of the above cases, for a total of one count of murder, 3 counts of attempted murder, and one count of shooting into an occuppied dwelling.

Suspect Hugo Chavez was indicted for the murder of Raul Lopez. Chavez’s charges include one count of murder and one count of attempted murder.

Suspect Eddie Sandoval was indicted on the McCreery Avenue shooting. Sandoval’s charges include two counts of attempted murder and one count of shooting into an occupied dwelling.

The indictments were the result of a lengthy investigation involving the San Jose Police Department’s Homicide Unit and the Santa Clara County District Attorney’s Office.
