On 10/08/2011, at approximately 11:01 A.M., San Jose Police Officers responded to the area of Park Avenue and Sunol Street on a report that a Santa Clara County Sheriff’s Deputy had been involved in a shooting at that location.
Preliminary investigation into the shooting revealed that a sheriff’s deputy was on routine patrol when he spotted a suspicious vehicle. As the deputy approached the vehicle to contact the occupant, the dispatcher advised him that the vehicle was stolen. The suspect then displayed behavior that the deputy considered threatening.
The deputy fired several rounds at the suspect, none of which struck the suspect. The suspect fled to a nearby industrial yard at 255 South Montgomery Street. A search team of officers located the suspect a short time later and took him into custody. The suspect was booked into the Santa Clara County Main Jail for auto theft, possession of stolen property, and parole violation.
The deputy has been placed on routine paid administrative leave. The San Jose Police Department’s Homicide Unit is investigating the shooting due to the fact that it occurred in San Jose Police jurisdiction.
