* David Vargas was Arraigned on Murder and Attempted Murder Charges in Contra Costa County

A 21-year-old Oakley man was arraigned today on murder and attempted murder charges in connection with a drive-by shooting in Oakley on Saturday, but did not enter a plea. David Vargas was charged earlier today with murder with a special-circumstance allegation that he killed the victim by shooting from a motor vehicle, Deputy District Attorney Dominique Yancey said.

 He also faces charges of premeditated attempted murder, shooting at an occupied motor vehicle, and shooting from a motor vehicle, plus several enhancements, Yancey said. He was arraigned this afternoon in Contra Costa County Superior Court in Martinez, where he was referred to the public defender’s office.

 The shooting happened at about 7 p.m. Saturday near O’Hara Avenue and Laurel Road, according to the Contra Costa County Sheriff’s Office. Police arrived at the scene to find 22-year-old Oakley resident Omar Martinez fatally wounded. A second victim, a 16-year-old boy, was taken to John Muir Medical Center in Walnut Creek. He is expected to survive. Investigators said they believe Vargas knew the victims and that he was involved in an argument with them before the shooting.

    Vargas is being held without bail in county jail. He is scheduled to return to court Aug. 4 to be assigned an attorney and enter a plea.
