On February 28th, 2005, San Jose Police Officers responded to the 300 Block of Keyes Street on a report of a person down. Upon their arrival, officers located the victim, who was unconscious. The victim remained unconscious until June 21st, 2011, when he was pronounced dead while under hospice care.
The investigation into the beating revealed that the victim and suspect had a verbal altercation at a nearby bar. The victim left the bar on foot. Shortly thereafter, the suspect exited the bar and found that his vehicle had been vandalized. The suspect believed that the victim was responsible for the vandalism and confronted him down the street. The suspect attacked the victim. The victim sustained a head injury as a result of the attack, and subsequently lost consciousness. The victim remained unconscious and eventually was admitted to a hospice care facility.
Eventually, San Jose Police Detectives identified and arrested the suspect. The suspect was later released after the Santa Clara District Attorney’s Office declined to file criminal charges. The suspect was subsequently deported to Mexico in 2005. The case is currently under review by the Santa Clara County District Attorney’s Office. The suspect’s whereabouts are not known.
