* Jose Everardo Luna and Steven Anthony Davis arrested for alleged Bank of America at 565 W. Capitol Expressway in San Jose

On 12/28/10, at 10:16 a.m., the San Jose Police Department responded to a reported bank robbery at Bank of America, 565 W. Capitol Expressway, in San Jose. The investigation revealed that Jose Everardo Luna, 21, of San Jose, employee of Bank of America, conspired with Steven Anthony Davis, 20, of Morgan Hill, to simulate a robbery.

Davis entered the Bank of America, wearing sunglasses and a hooded shirt, and presented a robbery demand note to Luna, who was working as a teller in that bank. Luna gave Davis an undisclosed amount of cash from the bank. Davis fled and Luna reported to his co-workers and to police that he had been robbed.

Detectives from the San Jose Police Department, Robbery and Day Detective units, pursued the investigation as an actual robbery. Bank of America security personnel assisted with the investigation, providing information which was crucial in determining the robbery was in fact a planned theft by Luna and Davis. Detectives arrested Luna during the active investigation. Davis self-surrendered at the San Jose Police Department on 12/28/10 at 11:30 p.m., with the money stolen from Bank of America in his possession.

Over the past 2 years, several similar crimes have occurred in the city of San Jose, and it is the San Jose Police Department’s hope that knowledge of these incidents will help banks and other such businesses in preventing future similar incidents.
