Two people were sentenced today to life in prison without parole for the January 2004 shooting death of a Hayward couple that had received a $380,000 disability settlement.In sentencing Shawndra Boode and Jose Rodriguez, both 30, Alameda County Superior Court Judge Joan Carwright said the shooting deaths of David and Cathy Brooks at their home in the 28000 block of East 12th Street in Hayward “was one of the most brutal, cold-blooded murders I’ve seen. “Prosecutor Bill Boselli said Boode was renting a room at the Brooks’ home and discovered David Brooks, who had been injured while working at his job at a warehouse, had received a large disability settlement.Boselli said witnesses testified that Boode shot the couple with a .357-caliber Magnum.He said Rodriguez provided “the muscle” in the incident because “he’s large in stature” and would have been able to take the check by force if the shooting had gone awry.The prosecutor said the $380,000 check was never found.Boselli said it would have been difficult for Boode and Rodriguez to cash the check but there was testimony that Boode knew someone whom she thought would be able to cash the check for her.On April 1, after less than two hours of deliberation, a jury convicted Boode and Rodriguez of two counts each of first-degree murder as well as the special circumstances of multiple murder and murder during the commission of a robbery.Boode’s lawyer, Deborah Levy, said she thinks the witnesses who testified against Boode and Rodriguez were unreliable and there “was so much reasonable doubt” that Boode shouldn’t have been convicted. Rodriguez’s attorney, Al Thews, said he believes that the witnesses who testified against Rodriguez and Boode “had a motive to lie” because they may have also been involved in the crime. He said, “I’m disappointed with the jury’s verdict” because he had asked that Rodriguez be acquitted.
