On Tuesday, March 2, Sheriff’s detectives arrested Hong Ma of Cupertino for vehicular manslaughter.After a thorough investigation and review by the Santa Clara County Sheriff’s Office and District Attorney’s Office, the District Attorney has filed one misdemeanor and one infraction against 47- year old Hong Ma, arising out of Ma’s driving a vehicle in October 2009, in which she struck and killed a five year-old boy.Ma has been charged with a violation of Penal Code section 192(c)(2), Misdemeanor Vehicular Manslaughter, which has a maximum punishment of one year in jail, and a violation of Vehicle Code section 27360(b), Transporting a Child Without a Proper Seat Restraint, which has a maximum punishment of a $100 fine.
On October 15, 2009, Ma was driving children back to Elite Chinese School from Lincoln Elementary for their after school program. Three of the children got out of her SUV, and two arrived safely in front of the school. Five year old Nelson Wei was knocked down and run over by the SUV. He later died at the hospital.
Ma will be arraigned on these charges on Friday, March 5, at 1:30 p.m.
