A standoff involving a man with a rifle who refused to leave a wooded area in Benicia ended peacefully this week without anyone being struck by gunfire, police said Wednesday.Officers had responded to a report that a vehicle was blocking half a driveway on Lake Herman Road at about 7 p.m. Tuesday and began looking for the driver when they heard a man yelling from a wooded area out of view, Benicia police Lt. Mike Daley said. The man, 27-year-old Vallejo resident Anthony DiGiovanni, refused to exit the woods after the officers identified themselves and ordered him to show himself, according to Daley. He was armed with a rifle and “verbally aggressive” toward the officers, Daley said.DiGiovanni then allegedly told the officers to “come and get him,” and then swung the rifle in their direction, Daley said. The officers then moved out of view until further assistance arrived, at which point DiGiovanni fired one round from his rifle, according to Daley. No one was struck, and the officers were unable to determine which direction he fired the gun, Daley said.Other agencies responded to assist Benicia police, including the California Highway Patrol, the Benicia/Vallejo SWAT team, Solano County sheriff’s deputies, and patrol volunteers from the Benicia Police Department. At about 10:30 p.m., after moving around inside the wooded area for more than three hours, DiGiovanni surrendered to CHP officers who had contained the side of Lake Herman that he had walked to, Daley said.He was not carrying the rifle when he surrendered, and officers located it in the woods shortly after, according to Daley.Authorities learned later that DiGiovanni was intoxicated and apparently suffering “serious personal issues,” Daley said.He was arrested on suspicion of brandishing a firearm at police, discharging a firearm in city limits, impeding an officer in the performance of his duties and public intoxication. He was also held for a mental health evaluation, Daley said.
