* Kenneth Carter Of Marin Gets Six-Year Term For Murder Of Leonard Smith On Nov 15th

A 43-year-old man was sentenced this morning to six years in prison for the stabbing death of a man in his Marin City apartment in November.Marin County Superior Court Judge Kelly Simmons sentenced 43-year-old Kenneth Ray Carter, of Marin City, to the mid-term for voluntary manslaughter.Carter pleaded guilty toward the end of the prosecution’s case at his trial in September, Deputy District Attorney Shawn Spaulding said. The prosecution argued for the aggravated, 11-year term, Spaulding said. The defense and Judge Simmons agreed Carter would be sentenced to the six-year term because there was some provocation of Carter by the victim, 58-year-old Leonard Smith,Spaulding said.Smith was stabbed once in the torso during an argument that escalated to a fight in Smith’s Drake Avenue apartment in Marin City on Nov. 15, the Marin County Sheriff’s Office said.Smith, Carter and others present in the apartment had been drinking, the sheriff’s office said. Carter was charged with voluntary manslaughter instead of murder.Defense attorney Jack Rauch was not available for comment today.
