The Santa Clara County Sheriff’s Office is seeking public’s help in identifying a suspect in connection with a homicide that occurred on May 10, 2004 at the Rainbow Smoke Shop located in the 1500 block of W. San Carlos Street. Recently, sheriff’s homicide detectives were successful in locating a witness, who was able to provide a description of one of the three suspects to a police sketch artist. The suspect is described as either an Asian or Hispanic male, 5’8”, thin build, with a tan or olive complexion. The suspect has a distinct tattoo on the right side of his neck. It is unknown if this is a complete tattoo or is partially covered. The suspect was between 18 and 22 at the time of the incident. His current age would be somewhere between 23 and 27. On May 10, 2004, sheriff’s deputies responded to a “shots fired” call at the Rainbow Smoke Shop. Upon arrival, the deputies found David Ramon Cruz, a store employee, of San Jose had been shot inside the store. The victim, who was 26 years old at the time of the incident, was declared dead at the scene. This investigation has been on-going since 2004.
