A jealous man who targeted his ex-girlfriend’s new boyfriend has been charged with murder for allegedly initiating an exchange of gunfire that resulted in his nephew’s death, Alameda County Assistant District Attorney Tom Rogers said today. Raul Soto-Estrada, 49,was arraigned in his hospital bed on Wednesday on a murder charge stemming from a shooting in the 2900 block of East Seventh Street in Oakland about 10:40 p.m.Sunday that claimed the life of his nephew, 21-year-old Victor Basulto of Oakland.Soto-Estrada also is charged with attempted murder for allegedly shooting his ex-girlfriend’s new boyfriend, who remains in serious condition with chest wounds.Rogers said Jaime Arandia-Soto, 22, of Oakland, another nephew who was with Soto-Estrada, was charged with being an accessory to murder.Authorities said Arandia-Soto drove his uncle and cousin away from the shooting scene and got rid of the pistol used in the shooting.Rogers said that even though Soto-Estrada didn’t personally shoot Basulto, he is charged with murder because it was a “provocative act” shooting. The prosecutor said Soto-Estrada’s actions caused others to retaliate and caused Basulto’s death. The shooting occurred in the same block where 18-year-old Francisco Villasenor of Oakland was shot to death about 17 hours earlier. However, Oakland police said the shootings weren’t directly related.Police said Soto-Estrada had been in a dispute with his ex-girlfriend, who lives on East Seventh Street and has a new boyfriend. Rogers said Soto-Estrada, Basulto and Arandia-Soto drove to the block Sunday night looking for the ex-girlfriend.They saw her and her new boyfriend with other people who had gathered at a street memorial for Villasenor and stopped their car, he said.As the woman and her boyfriend approached the car, Soto-Estrada shot at them, badly wounding the boyfriend, who was unarmed, Rogers said. Then, at least one other person at the memorial for Villasenor began shooting at the car, wounding Soto-Estrada and Basulto. They drove off and ended up a short time later at a hospital, where Basulto was pronounced dead and Soto-Estrada was hospitalized for his wounds.Arandia-Soto was detained at the hospital.Rogers said police are still trying to identify the person or persons who shot at the car from the street and killed Basulto and wounded Soto-Estrada.
