On May 4, 2009, the San Jose Police Department began investigating a rape in concert involving three unknown suspects who were associated with a known outlaw motorcycle gang called the Vagos. During the course of the investigation, the victim identified Eduardo Larios, Jose Portillo-Garcia, and Edwin Portillo-Garcia as the persons who sexually assaulted her at their clubhouse. On June 8, 2009, the San Jose Police Department executed a search warrant at the Vagos Clubhouse in San Jose and seized evidence related to the case. On June 9, 2009, Eduardo Larios and Jose Portillo-Garcia were arrested by San Jose Police Departments M.E.R.G.E. Unit and charged with multiple counts of sexual assault by the District Attorneys Office. On June 10, 2009, Edwin Portillo-Garcia was arrested by the Elk Grove Police Department on a one million dollar arrest warrant for the sexual assault.
