MORNING FATAL CRASH
An alleged drunken driver was arrested on suspicion of vehicular manslaughter today after one of his passengers was killed and another injured when he drove into a tree in San Jose, police said.The crash happened at about 1:40 a.m. on Capitol Expressway at Senter Road.Police said 23-year-old Christopher Lazaro, of Daly City, was driving east on Capitol Expressway when he lost control of his 2003 Nissan Altima, which went off the road and struck a tree.Lazaro then drove to a nearby business and asked employees to call 911, according to police.One of his passengers, 28-year-old San Jose resident Apollo Gregory Toledo, was killed in the crash, police said. A second passenger was taken to a local hospital to be treated for moderate injuries.Lazaro was arrested on suspicion of driving under the influence of alcohol and vehicular manslaughter, police said.Anyone with information regarding the case is asked to call San Jose police Investigator Mike O’Brien at (408) 277-4654.
